Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) govern access to and use of Notivo, a WhatsApp business messaging platform operated by Humziq (“Notivo,” “we,” “us”). By creating an account or otherwise using Notivo, you agree to be bound by these Terms on behalf of yourself and the organization you represent (“Customer” or “you”). If you do not agree, do not use Notivo.

2. Description of Service

Notivo allows Customers to import contacts, manage WhatsApp message templates, and send messages to their contacts through the Meta WhatsApp Business Platform, using a WhatsApp Business Account that the Customer owns and connects to Notivo.

3. Eligibility and Account Registration

You must be at least 18 years old and authorized to act on behalf of the organization you represent to create an account. Registration requires a valid email address, which is verified via a one-time code before the account becomes active. You are responsible for keeping your account credentials confidential and for all activity under your account.

4. Subscription Plans

Notivo is offered under multiple plan tiers (currently Starter, Growth, Agency, and Enterprise), each with associated limits on team seats and contact volume. We reserve the right to change plan structures, limits, or pricing, and will provide reasonable notice of material changes affecting an active subscription.

5. Acceptable Use

You agree not to use Notivo to:

• Send messages to any contact without a lawful basis and, where required, that contact's consent
• Send spam, unsolicited marketing without opt-in, or content that violates WhatsApp's Business Messaging Policy or Meta's Business Terms of Service
• Import or upload contact lists obtained through scraping, purchase from unauthorized sources, or any other means inconsistent with the contact's reasonable expectations
• Send unlawful, defamatory, fraudulent, hateful, or otherwise objectionable content
• Impersonate any person or organization, or misrepresent your affiliation with one
• Attempt to circumvent rate limits, security controls, or access other Customers' data

6. Your Responsibility for Contact Data

You represent and warrant that you have all necessary rights, permissions, and — where applicable — consent to upload, store, and message every contact you add to Notivo. You are solely responsible for honoring opt-out requests, complying with applicable data protection and telemarketing laws in your jurisdiction and your contacts' jurisdictions, and for the accuracy and legality of message content you send. You agree to indemnify Notivo against claims arising from your breach of this section.

7. WhatsApp Business Account

Notivo requires you to connect your own WhatsApp Business Account and Meta access credentials. You are responsible for maintaining that account's standing with Meta, including compliance with Meta's own policies. Notivo is not responsible for restrictions, bans, or message-quality throttling imposed by Meta on your WhatsApp Business Account.

8. Suspension and Termination

We may suspend or terminate your access to Notivo, with or without notice, if we reasonably believe you have violated these Terms, WhatsApp's policies, or applicable law, or if your use poses a risk to Notivo, other Customers, or Recipients. You may stop using Notivo and close your account at any time.

9. Intellectual Property

Notivo and its underlying software remain the property of Humziq. You retain all rights to the contact data and message content you upload or send through the platform.

10. Disclaimers

Notivo is provided “as is” without warranties of any kind. We do not guarantee that any message will be delivered, as delivery depends on the WhatsApp Business Platform, the Recipient's device and settings, and factors outside our control.

11. Limitation of Liability

To the maximum extent permitted by law, Notivo and Humziq will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service.

12. Governing Law

These Terms are governed by the laws of Pakistan, without regard to conflict-of-law principles, unless otherwise required by applicable local law.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of Notivo after changes take effect constitutes acceptance of the revised Terms.
